OBJECTIVE: Establish the criteria for the collection, storage, use, circulation and deletion of personal data processed by ETNICO S.A.S, as data controller. ETNICO S.A.S. will use the information for the following purposes:

  • Carry out procedures for the development of the corporate purpose of ETNICO S.A.S. in what has to do with the fulfillment of the object of the contract entered into with the owner of the information.
  • Make invitations to events and offer new products and services.
  • Manage processing of requests, complaints or claims.
  • Carry out satisfaction surveys regarding the goods and services offered by ETNICO S.A.S. who will act as responsible for the processing of the information.
  • Provide contact information to your sales force and/or network of distributors, telemarketing, market research and any third party with which ETNICO S.A.S. has a contractual link for the development of activities of this type [market research, telemarketing, etc.] or for the execution thereof.
  • Contact the Owner through telephone means to carry out surveys, studies and/or confirmation of personal data necessary for the execution of a contractual relationship.
  • Contact the Owner through electronic means [SMS or chat to send news related to loyalty campaigns or service improvement].
  • Contact the Owner via email to send statements, account statements or invoices in relation to the obligations derived from the contract entered into between the parties.
  • Comply with the obligations contracted by ETNICO S.A.S. with the Owner of the information, in relation to the payment of salaries, social benefits and other remuneration established in the employment and/or service provision contract or as provided by law.
  • Transfer personal data collected in the country to partner companies of ETNIKO SAS to comply with applicable anti-money laundering regulations.
  • Transmit personal data outside the country to third parties with whom ETNICO S.A.S. has signed a data processing contract and it is necessary to deliver it to fulfill the contractual object.
  • Provide the services offered by ETNICO S.A.S. and accepted in the signed contract.
  • Provide information to third parties with whom ETNICO S.A.S. has a contractual relationship and it is necessary to deliver it for the fulfillment of the contracted object.

SCOPE: This policy applies to all personal information registered in the databases of ETNICO S.A.S. , who acts as Responsible for the processing of personal data.

 

OBLIGATIONS: This policy is mandatory and strict compliance for ETNICO S.A.S, its administrators, employees, contractors and collaborators in general.

 

RESPONSIBLE FOR THE TREATMENT: ETNICO S.A.S. , is a commercial company legally incorporated by private document dated August 1, 1995 in Barranquilla, registered in the commercial registry of the Chamber of Commerce of Barranquilla on August 1, 1995 in Barranquilla, 802.001.100 – 2.

 

RIGHTS OF THE OWNERS: As the owner of your personal data, you have the right to: (i) Access free of charge the data provided that has been processed; (ii) Know, update and rectify your information regarding partial, inaccurate, incomplete, fragmented, misleading data, or data whose processing is prohibited or not.

ATTENTION TO PETITIONS, CONSULTATIONS AND CLAIMS: The customer service area is the department in charge of processing the requests of the owners to make their rights effective.

 

PROCEDURE FOR THE EXERCISE OF THE RIGHT OF HABEAS DATA: In compliance with the regulations on personal data protection, ETNICO S.A.S. presents the procedure and minimum requirements for the exercise of your rights.

 

For the filing and attention of your request, we ask you to provide the following information:
1) Full name and surname; 2) Contact information [Physical and/or electronic address and contact telephone numbers]; 3) Means to receive a response to your request; 4) Reason(s)/fact(s) that give rise to the claim with a brief description of the right you wish to exercise [know, update, rectify, request proof of the authorization granted, revoke it, delete, access information]; 5) Signature [if necessary] and personal identification number [citizenship card, identity card, immigration card or passport number].

 

The maximum period provided by law to resolve your claim is fifteen (15) business days, counting from the day following the date of receipt. When it is not possible to address the claim within said term, ETNICO S.A.S. will inform the interested party of the reasons for the delay and the date on which their claim will be addressed, which in no case may exceed eight (8) business days following the expiration of the first term.

 

Once the terms indicated by Law 1581 of 2012 and the other rules that regulate or complement it have been met, the Owner who is denied, totally or partially, the exercise of the rights of access, updating, rectification, deletion and revocation, may bring your case to the attention of the Superintendency of Industry and Commerce [Delegation for the Protection of Personal Data].

 

The databases in which personal data will be recorded will be valid as long as the Owner of the information does not expressly request the person responsible to revoke the authorization and/or request the deletion of the data, and there is no legal duty to preserve the information.

Contents and Typographical Errors Clause.

ETNICO SAS reserves the right to modify the commercial offer presented on the website (modifications to products, prices, promotions and other commercial and service conditions) at any time. We make every effort to ensure that the information contained on the website is shown truthfully and without typographical errors, however, in the event that at any time an error of this type or errors in the systems occurs, beyond the control of the will of ETNICO SAS, it will be corrected immediately. If there is an error mentioned above and a customer has made a purchase decision based on said error, we will inform the customer of said error and ETNICO SAS will have the right to deny or cancel any order generated for said products. If the customer's credit or debit card has already been charged for the balance and the order is canceled for the aforementioned reasons, ETNICO SAS will issue a voucher to said credit or debit card account for the amount of the canceled price.
